This Privacy Notice explains how Ethos Collective LLC, a Colorado limited liability company (or “Ethos Collective”), and the third-party service providers that help us collect, process, or disclose your data or information. It applies to all Ethos Collective websites, which, collectively, make up our “Platform.” Ethos Collective owns and operates the Platform. The Platform is an e-commerce system for Ethos Collective apparel or merchandise only.

Ethos Collective may modify this Privacy Notice from time to time. The effective date for this Privacy Notice is displayed above. Any changes to this Privacy Notice will be published on this Platform. If we make material changes to the Privacy Notice based on material changes to how we or third parties that assist us collect, use, or disclose your personal data, we will inform you.

This Privacy Notice incorporates by reference the Platform’s Terms of Use (or “Terms”), also published on this Platform. The Terms and the Privacy Notice, combined, constitute a legal agreement between You and Ethos Collective. Please read the current versions of both documents prior to using the Platform. By using the Platform, you accept and agree to comply with the Terms and this Privacy Notice. 

Do not use the Platform if you do not accept or agree to comply with all the Terms and this Privacy Notice.

Ethos Collective takes no responsibility for any third party’s data privacy or information security practices. Links to third-party websites that may be found on the Platform, unless expressly stated, are not endorsements of the practices, products, or services of those third parties. Please read the privacy notices or policies and terms of use documents for each third-party company’s website to learn more about its data privacy or information security practices. 

As our Terms clarify, people under the age 18 are not authorized to use the Platform. We do not knowingly collect personal information from our Platform from unauthorized users, which include users under 18. Nor does the Platform knowingly collect information from children under 13. If you believe we have collected information about someone who was not authorized to use our Platform, which includes everyone under 18, please contact us.  

This notice is in a form designed to be reasonably accessible to authorized users of our Platform who have disabilities.

We do not sell your information.

Ethos Collective and third-party vendors that assist us may collect data or information from or about you that is available through public sources or that you provide us for business or commercial purposes when you access or publish information to our Platform. 

If you do not consent to us or our third-party vendors collecting information or data about or from you while you access or publish information to our Platform, do not use the Platform. 

Consenting to providing us with your data or information by accessing or using our Platform is always your choice. But we will not require you to consent to the collection, use, or disclosure of information as a condition to conducting business with Ethos Collective, unless we will require your data or information to fulfill our commercial obligations to or conduct business with you.

We may collect, process, or disclose the following categories of data or information for the business or commercial purposes described below.

  • respond to your business, contractual, or commercial requests for data, information, products, or services from us;
  • send information to you about the products and services we offer you;
  • comply with lawful requests for data or information about you that we receive from government agencies or individuals who have demonstrated that they have the legal authority to obtain the data or information about you that they requested;
  • protect our legal interests or the legal interests of our business partners;
  • protect the legal interests or safety of our customers;
  • reasonably maintain the security of data or information that we collect, process, or disclose for business or commercial purposes;
  • maintain the integrity and security of our Platform; or
  • other reasons that are explained in documents that we publish on our Platform.

How We May Disclose Data or Information

Ethos Collective and the third-party vendors working under our direction that assist us with the collection, processing, or disclosure of data and information may disclose the data and information that we collect from or about you in any of the following ways:

  • to third-party vendors to help us collect, process, or disclose data and information in accordance with the Terms and this Privacy Notice;
  • to our business partners to the extent the law allows without requiring additional consent from you other than you will have provided by accessing or using our Platform or by consenting in other ways;
  • to third parties that may help us market our products or services to you;
  • to another entity in the event that Ethos Collective undergoes a joint venture, merger, reorganization, sale, or transfer of our assets to another entity; 
  • to comply with lawful requests for data or information about you that we receive from government agencies or individuals who have demonstrated that they have the legal authority to obtain the data or information about you;
  • to protect our legal interests or the legal interests of our business partners;
  • to protect the legal interests or safety of our customers;
  • to reasonably maintain the security of data or information that we collect, process, or disclose for business or commercial purposes;
  • as applicable laws require; 
  • other ways for which you will have provided your consent; or
  • other ways that are explained in documents that we publish on our Platform.

How We Retain Data or Information

Ethos Collective will retain the data and information that we collect from or about you for as long as required to reasonably comply with applicable laws, or as long as we deem appropriate to fulfill the purpose for which we collected the data or information, as permitted by law. 

How We Safeguard Data or Information

Ethos Collective and the third-party vendors working under our direction that help us collect, process, or disclose data and information from or about you use reasonable security measures, based on the sensitivity levels of the data and information we collect and process, to prevent others from obtaining non-public data or information about you or unlawfully abusing non-public data or information about you. To help us safeguard the data or information we collect from or about you, we rely on you to take reasonable steps to protect the confidentiality of your data and information.

How You May Choose How We Use Your Data or Information

If you receive marketing emails from Ethos Collective and want to opt-out from receiving them, please use the unsubscribe link or option that will be provided to you in the marketing emails. If you cannot locate the unsubscribe link or option in the email, please contact us using the email at the end of this Privacy Notice.

If there is data or information about you on our Platform that you want to review, correct, update, or delete, please contact us using the email at the end of this Privacy Notice. If you contact us to review, correct, update, or delete data or information about you that Ethos Collective collected through the Platform, please specify the data or information that you want to review, correct, update, or delete. We will take reasonable steps to comply with your requests as required by applicable law. Ethos Collective has a right to take reasonable steps to confirm your identity prior to responding to or acting on your request.

Cookies, Tracking Tools, and Do Not Track Notices

A cookie is a text file that is placed on your hard disk by a web page server. You may accept or decline these cookies. If you choose to decline them, you may not be able to fully experience the Platform’s interactive features.

At all times, you may control cookies and tracking tools while interacting with our Platform and the software tools you use to access it. The Platform or third-party vendors that help us collect or process data or information that you or your devices provide us may use cookies to help personalize your interactions with the Platform. 

In addition to cookies, Ethos Collective may also use other tracking technologies while you interact with the Platform. We may use these tracking tools for purposes that are consistent with the business and commercial purposes described in this Privacy Notice and our Terms.

Some Internet browsing software offers “do not track” features. These features may allow you to instruct websites not to track your activities. We do not guarantee that our Platform will respond to do not track signals. 

California Consumer Privacy Rights Notice

People who reside in California and use the Platform have privacy rights pertaining to personal information Ethos Collective has collected about them that are explained below.

  • The right to request that we identify to them (1) the categories of personal information we have collected, disclosed or sold about them during the last 12 months, (2) the categories of sources from which the personal information was collected, (3) the business purpose for which we use this information, and (4) the categories of third parties with whom we share or have shared their personal information during the last 12 months.
  • The right to request that we provide them access to or disclose to them the specific pieces of personal information we have collected about them during the last 12 months.
  • The right to request that we delete personal information that we collected from them, subject to certain exceptions.
  • The right to request that we correct inaccurate personal information we have about them, taking into account the nature of the personal information and the purposes for processing of the personal information.
  • The right to opt-out of the sale or sharing of their personal information to third parties, if applicable. 
  • The right to limit the use or disclosure of their sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected when they requested those goods or services.
  • The right to designate an authorized agent to submit one of the above requests on their behalf. 
  • The right to not be discriminated against by receiving different or less favorable pricing, service or financial incentive for exercising any of the above rights.

California residents who want to exercise these privacy rights and choices, may follow the instructions below:

  • You may request that we identify or provide you access to your personal information twice in a 12-month period. To do so, please contact us by email or mail, using the information provided at the end of this document. 
  • In response to a request to identify your personal information, we will identify to you (1) the categories of personal information we have collected, disclosed or sold about you in the last 12 months, (2) the categories of sources from which the personal information was collected, (3) the business purpose for which we use this information, and (4) the categories of third parties with whom we share or have shared your personal information in the last 12 months. 
  • In response to a request to access your personal information, we will produce a document detailing the personal information we have collected, disclosed, and/or sold about you. This document will be delivered by mail or electronically at your request.
  • You may request that Ethos Collective delete the personal information we collected or maintain about you. To do so, please contact us by email or mail, using the information provided at the end of this document. Note, we may need to retain certain personal information as permitted by law, such as to complete the transaction for which the personal information was collected; provide a requested good or service; detect security incidents; protect against malicious, deceptive, fraudulent or illegal activities; comply with legal obligations, or to enable internal uses that are lawful within the context in which you provided the information.
  • We will take steps to verify your identity before fulfilling any of the above requests. We will verify your identity through existing authentication.
